Dunnellon, Florida Red Light Camera Citations

I finally got to litigate the Dunnellon red Light Camera; after what feels like an eternity of fielding calls a resident finally issued a challenge to the government. The Dunnellon red light camera case was dismissed. Fighting the red light camera ticket was worth it because the government is lacking a very necessary step. I am not going to say what they are missing. If the Dunnellon officer in court was paying attention, they know why the case was dismissed. Several people have challenged the red citations issued from red light cameras across the state. Recently the Fourth District Court of Appeals held that the statutory scheme does not violate the Equal Protection clause of the United States and Florida Constitutions because 'owners' of vehicles are a different class of citizens than 'drivers' of vehicles. My constitutional arguments were going to be different as I actually agree that the driver is not necessarily the owner. (see my blog Granny's got a gun for an example).

I still feel that the violation is of the fifth and fourteenth amendment and not of the equal protection clause. For example if you allow a fourteen year old to drive, you have committed the criminal offense of allowing an unauthorized minor to drive. The statutory scheme of the red light cameras requires that, in order to avoid the citation, you must file a sworn statement which could be in direct violation of the constitution. The shifting of the burden from the government to the citizen is fraught with problems and is why the government is supposed to prove its case against you and not the other way around.

HELLO - RE: CAMERAS IN DUNNELLON - I HAVE DRIVEN 45 YEARS (FAMILY HERE SINCE CIVIL WAR)...HAVE HAD 3 TICKETS IN 45 YEARS....2 HAVE BEEN FOR THESE CAMERAS (1 LAST YR., 1 THIS YR)....THESE YELLOW LIGHTS ARE TIMED SO SHORT.....YOU CANNOT, I REPEAT CANNOT, I REPEAT CANNOT STOP. HAVE CALLED ALL OVER....NOBODY CARES....WILLING TO HELP WHOMEVER.

Hello: RE: Camera in Dunnellon: I have been driving for 48 years have had only two tickets prior to moving to Dunnellon, and pulled over for 2 speed warnings and now I am looking at a traffic violation failure to comply with a steady red light. The video shows I was stopped. The vehicle ahead of me was at the crossbar and was stopped. He moved and I moved behind him to finish this right hand turn onto Powell Rd. and got this flash. Why do they think I wasnt in compliance, my car was stopped, the vehicle ahead was stopped. What do they want at these intersections? I would like to see that this vehicle ahead of me was ticketed as well. In my opinion both of us were in compliance. There were no oncoming traffic in the opposite turn lane, in fact, the whole intersection was clear, hardly no cars at all. Can somebody help or try and educate me a little. I am retired and this comes to about 16% of my monthly income, and this puts a crinkle in everything. I dont go around deliberately running lights or even have a desire to do so. My driving record is very noteworthy. I have read from several resources that Dunellon's "powers" wants to change the "traffic behavior"? What in the heck are they talking about? I would like to see what the accident histories are for this area for the past five years. I believe it's a # grab and nothing more. If they continue they can forget about their little Dummellon because everybody will be moving out.

I agree...I have been driving for almost 50 years and have NO other tickets but have gotten two tickets in Dunnellon in the last six months. The first was at one of those "impossible to stop quick enough" when the light changed after only two cars had gone through...The second one they said I did not stop going into Walmart but you can clearly see my brake lights are on in the photos. This is all about the revenue Dunnellon is receiving from these tickets. Dunnellon Merchants BEWARE...I will no longer be going to or through Dunnellon because of this and will NOT be spending any money there.

On Thursday, May 2nd at 4;17 pm traveling southbound on 41 at the intersection Brooks St. I noticed the REDLIGHT camera flash, it happend to be Dunnellon Police veh. traveling northbound making a right turn onto Brooks st. apparently not coming to a complete stop ---- picture taken------ I went to police dept., check reqesting to speak to the officer the next day, not on duty at that time , I left my # with the dispatcher
integrity check, my question is - are they special ticket free -
driver was not in emergency mode no lights or siren for she
parked in a vacant lot behind the drug store untill 4;31pm then driving southbound on 41
I would like to see a paid ticket by the driver, not by the city
THEY SHOULD PRACTICE WHAT THEY PREACH
