DUI and the Ignition Interlock Device

In DUI defense a common question or problem involves the "ignition interlock device". The law on the ignition interlock device states that the Department of Highway Safety and Motor Vehicles "shall require the placement of a department-approved ignition interlock device for any person convicted of committing an offense of driving under the influence as specified".

Give me a break: Traffic Tickets that are reduced, changed or lowered roadside

Some traffic ticket clients mention that the officer "gave me a discount" or reduced the fine" at the stop. Otherwise we will hear "the ticket was supposed to be $$ and he cited me $$". This can cause confusion and the trooper, deputy or officer will not likely clear it up.

Fleeing or Eluding: Another Criminal Traffic Case

A criminal traffic case of fleeing became news recently as an alleged car chase that crossed Sumter and Marion Counties came to a stop in Alachua County. Sometimes a person accused of fleeing and eluding the police will also be charged with reckless driving, resisting arrest or obstruction of justice. Fleeing or eluding can also be charged as what is known as aggravated fleeing. Aggravated fleeing or eluding can also be charged with serious bodily injury or death.

Do officers and witnesses appear at traffic hearing?

A question that is regularly asked of me is whether officers and witnesses appear at traffic hearings. The communities of Gainesville, Waldo and Alachua (Alachua County) or Ocala, Belleview and Dunnellon (Marion County) or Starke and Lawtey (Bradford County) or Lake City (Columbia County) are very different than the communities in South Florida.  My understanding is that no show rates are higher down south, regardless, here in North Florida, witnesses and officers do fail to appear.
