HTO No! (Florida Habitual Traffic Offender)

For some it is getting the letter or notice of Habitual Traffic Offender ("HTO") in the mail. For others it is getting arrested after being pulled over for no reason or even if there was a traffic citation, surprise! The license is being, or has been, suspended for five (5) years. The driver has been habitualized!  After Notice from the DHSMV, we can determine the next step to attempt to reinstate the license. An analysis of the driver record may be required. 

Waldo, Florida Traffic Ticket Quotas

The top was blown off an illegal traffic ticket quota requirement at the city of Waldo, Florida just days after I issued a blog about traffic ticket quotas. According to a presentation by several officers to the city council, Waldo, long designated a speed trap, did in fact maintain an illegal traffic ticket quota. While this traffic citation quota allegation remains under investigation, two officers have been suspended. Obviously, those officers failed to appear in court this morning.

Fleeing or Eluding: Another Criminal Traffic Case

A criminal traffic case of fleeing became news recently as an alleged car chase that crossed Sumter and Marion Counties came to a stop in Alachua County. Sometimes a person accused of fleeing and eluding the police will also be charged with reckless driving, resisting arrest or obstruction of justice. Fleeing or eluding can also be charged as what is known as aggravated fleeing. Aggravated fleeing or eluding can also be charged with serious bodily injury or death.

Florida Ban on Texting While Driving Law

Yesterday, May 28, 2013 the Governor signed into law SB-52 a ban on texting while driving in Florida. A violation of the texting law is a non-moving violation and can only be enforced as a secondary offense. This means you must be pulled over for another reason other than texting. A driver charged with violating the law is subject to six points if there is a crash or two additional points if the primary moving violation occurred within a school zone.

The Move Over Law Traffic Tickets

The Florida Move Over Law requires that a driver move over or slow down to 20 miles per hour under the speed limit when approaching an authorized emergency vehicle that is using any visual signals and is parked on the side of the road, or a wrecker displaying amber or flashing lights that is performing a recovery or loading on the roadside, or sanitation vehcile peforming its function.
